Welcome to Nuts. In these Terms, “we,” “us,” and “our” mean Nuts. We operate this store, website, and their information, content, functions, tools, merchandise, and services to offer customers a carefully selected retail experience (the “Services”). Shopify powers the technology through which those Services are supplied.
These terms and conditions, together with the policies they incorporate, explain the rights and duties that apply whenever the Services are used (collectively, the “Terms”).

Accepting these Terms represents that you have reached the legal-adulthood threshold that applies in your state or province and that any minor dependent using the Services on a device you own, buy, or manage does so with your permission.
Browsing, accessing, or buying through the Services may require an email address and billing, payment, or shipping details. You represent and warrant that every item of information supplied to the store is accurate, current, and complete and that you hold the rights needed to provide it.
You alone are responsible for securing account credentials and for activity occurring through the account. The account may not be sold, assigned, licensed, or transferred to another person.
SECTION 2 - OUR PRODUCTS
We try to depict products and services accurately. Screen type, configuration, and device settings can nevertheless cause colors or appearance to differ from the physical item.
We do not promise that a purchased item’s appearance or quality will satisfy personal expectations or match an online rendering exactly.
Descriptions can be changed at our discretion without prior notice. We may discontinue any product and may restrict quantities offered to a person, place, or jurisdiction on an individual basis.
SECTION 3 - ORDERS
Submitting an order is an offer to buy. Nuts may accept or reject that offer for any reason in its discretion, and acceptance occurs only when Nuts confirms it. Payment must be received and processed first. Review the order before submitting it because cancellation may no longer be possible after acceptance. Should an order be rejected, changed, or cancelled, we will try to notify you using the email, billing address, or telephone number supplied with it.
Returns and exchanges are available only under the Refund Policy at /pages/refund-policy.
You represent and warrant that purchases are intended for personal or household use, not commercial resale or export.
SECTION 4 - PRICES AND BILLING
Prices, promotions, and discounts can change without notice. The amount charged is the price effective when the order is submitted and appears in the confirmation email. Unless expressly stated otherwise, displayed prices exclude taxes, delivery, handling, customs, and import charges.
Prices in this online store may differ from physical-store prices or offers made through stores run by others. A promotion can carry separate conditions; if those conditions conflict with these Terms, the promotion conditions control.
You agree to provide accurate, complete, and current account, payment, and purchase details and to update them promptly, including email, card numbers, and expiration dates, so transactions can be completed and we can contact you.
You represent and warrant that card details are true, correct, and complete; you are authorized to use the card; the issuer will honor the charges; and you will pay the posted price plus applicable handling, shipping, and taxes.
SECTION 5 - SHIPPING AND DELIVERY
Delivery dates are estimates rather than guarantees. We are not liable for shipping delays caused by carriers, customs, or events beyond our control. Title and risk of loss transfer to the customer when the products are handed to the carrier.

The Services—including trademarks, branding, text, displays, images, graphics, reviews, video, audio, and the selection, arrangement, and design of those materials—belong to Nuts, its affiliates, or licensors and are protected by United States and foreign patent, copyright, trademark, and other intellectual-property laws.

Without prior written consent, no Service material may be reproduced, distributed, altered, turned into a derivative work, displayed or performed publicly, republished, downloaded, stored, or transmitted. Except for rights expressly granted here, no license or other right under intellectual property owned by Nuts, Shopify, or another party is conveyed. Unauthorized use may violate federal or state law, and Nuts reserves every right not expressly granted.
Names, logos, product or service names, designs, and slogans belonging to Nuts or its affiliates or licensors may not be used without Nuts’s prior written permission. Shopify’s corresponding marks belong to Shopify; all remaining marks appearing through the Services belong to their respective owners.
SECTION 7 - OPTIONAL TOOLS
The Services may provide access to tools supplied by third parties that we neither monitor nor control.
Those tools are made accessible “as is” and “as available,” without warranties, representations, conditions, or endorsement. We accept no liability arising from their use.
Using an optional external tool is entirely at your discretion and risk; review and accept the provider’s governing terms before using it.
Features, resources, or tools introduced later also form part of the Services and are governed by these Terms.
SECTION 8 - THIRD-PARTY LINKS
Materials, links, and embedded functions supplied or operated by other parties may appear in the Services. We are not responsible for examining or evaluating their content or accuracy. Leaving the Services to access them is at your own risk.
We are not liable for harm connected with an external site or with products, services, resources, or content obtained there. Nuts is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Nuts. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Nuts, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Nuts.
SECTION 10 - PRIVACY POLICY
Personal data collected through the Services is handled under our Privacy Policy at /pages/privacy-policy; some data is also governed separately by the privacy notice issued by Shopify. Using the Services acknowledges that both notices have been read.
Shopify hosts the Services and processes information about access and use so they can be delivered and improved. Data submitted through the Services can be transmitted to Shopify and providers located outside the customer’s country. Review our Privacy Policy for further details on how Nuts, Shopify, and our partners use personal data.
SECTION 11 - FEEDBACK
When you send ideas, reviews, suggestions, proposals, plans, or other feedback in any form (“Feedback”), you confer upon us a license carrying no royalty obligation, valid worldwide forever and capable of sublicensing to reproduce, use, edit, publish, distribute, and display it for every purpose through any form of media, including commercial purposes. That license may be used to operate, evaluate, provide, improve, enhance, or promote the Services and to perform our duties or exercise our rights under these Terms.
You represent and warrant that you own or hold all necessary rights to the Feedback, have disclosed compensation or incentives tied to it, and that it complies with these Terms. We have no duty to keep Feedback confidential, compensate its sender, or respond.
We may, without being required to, review, edit, or remove Feedback that we consider defamatory, libelous, threatening, offensive, unlawful, obscene, pornographic, otherwise objectionable, or violative of intellectual property or these Terms.
Feedback must not infringe a proprietary or personal right, including personality, privacy, trademark, or copyright; contain unlawful, abusive, libelous, or obscene matter or malware; supply an email address that is false; impersonate another person; or misrepresent its origin. You are solely responsible for Feedback and its accuracy, and we assume no responsibility or liability for Feedback submitted by you or anyone else.

You also agree not to introduce viruses or malicious code; duplicate, copy, reproduce, extract, sell, resell, or exploit any Service portion; collect or track another person’s data; spam, phish, pharm, or pretext; use a robot, spider, scraper, extraction tool, automated process, manual method, or AI tool (including agentic AI) to gain entry to the Services; or defeat security, authorization, robot-exclusion, or access-control measures. We may suspend, disable, or end an account without notice if a provision within these Terms is violated.
SECTION 14 - AGENTS
14.1 These Agent Terms apply whenever a person uses, permits, enables, or causes an Agent to interact with, enter, or make use of a Service. An “Agent” is software or a service capable of autonomous or semi-autonomous action for, or under instructions from, a person or entity and capable of execution for or through someone’s device without direct supervision.

We may exercise our exclusive judgment to end this agreement, or to withdraw access to any part of the Services at any time and without advance notice. Amounts incurred through the termination date remain payable.
Provisions concerning Intellectual Property, Feedback, Termination, Warranty Disclaimer, Governing Law, Assignment, Waiver and Entire Agreement, Severability, Indemnification, and Limitation of Liability, the Privacy Policy, and any other term intended by its nature to survive will remain effective after termination.

WE MAKE NO PROMISE THAT THE SERVICES WILL OPERATE FREE FROM ERRORS OR THAT IT WILL REMAIN SECURE, TIMELY, AND CONTINUOUS. TO THE MAXIMUM EXTENT THE LAW PERMITS, NUTS, ITS LICENSORS AND PROVIDERS, ITS CONTRACTORS AND AGENTS, ITS AFFILIATES, AND ITS EMPLOYEES, OFFICERS, DIRECTORS, AND PARTNERS, TOGETHER WITH SHOPIFY AND ITS AFFILIATES AND THEIR CORRESPONDING PARTIES, WILL NOT BE LIABLE FOR INJURY, LOSS, CLAIM, OR DAMAGES OF ANY KIND, WHETHER CONSEQUENTIAL, SPECIAL, PUNITIVE, INCIDENTAL, INDIRECT, OR DIRECT. THIS INCLUDES LOST PROFITS, REVENUE, SAVINGS, OR DATA, REPLACEMENT COSTS, AND COMPARABLE LOSS, WHETHER THE CLAIM SOUNDS UNDER ANY THEORY, INCLUDING STRICT LIABILITY, A TORT CLAIM (WITH NEGLIGENCE INCLUDED), OR CONTRACT AND WHETHER IT ARISES FROM USE OF A SERVICE OR PRODUCT, CONTENT ERRORS OR OMISSIONS, OR LOSS CONNECTED WITH CONTENT OR PRODUCTS MADE AVAILABLE THROUGH THE SERVICES, EVEN AFTER NOTICE THAT SUCH DAMAGE IS POSSIBLE.
SECTION 18 - INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Nuts, Shopify, and every affiliate and partner; every officer and director; every employee and agent; and each contractor, licensor, or service provider acting for us against losses, damages, liabilities, claims, and reasonable attorneys’ fees owed to another party because of your breach of these Terms or incorporated documents, violation of law or another party’s rights, or access to or use of the Services.
We will notify you of an indemnifiable claim; delayed notice relieves an obligation only to the extent material prejudice results. We may control, with the expense borne by you, defense and settlement and choose counsel, but we will not accept a settlement imposing nonmonetary duties on you without consent, which may not be unreasonably withheld. You must cooperate, including by supplying relevant records.
SECTION 19 - SEVERABILITY
If a provision is unlawful, void, or unenforceable, it remains enforceable to the fullest lawful extent and its unenforceable portion is severed. The remaining provisions retain their validity and enforceability.
SECTION 20 - WAIVER; ENTIRE AGREEMENT
A failure to exercise or enforce a right or provision is not a waiver of that right or provision.
These Terms and the policies or operating rules we post concerning the Services are the complete agreement between you and us regarding Service use. They replace prior and contemporaneous oral or written agreements, communications, and proposals, including earlier Terms versions.
An ambiguity will not be interpreted against the party that drafted these Terms.
SECTION 21 - ASSIGNMENT
Without our prior written consent, you may not assign, delegate, or transfer this agreement or a right or duty under it; an attempted transfer is void. We may assign, transfer, or delegate these Terms and our rights or duties without your consent or notice.
SECTION 22 - GOVERNING LAW
These Terms and separate agreements under which we supply Services are governed and interpreted under the law applied by the federal and state or territorial courts in the place of Nuts’s headquarters. You and Nuts consent to personal jurisdiction and venue in those courts.

Headings are included only for convenience and do not restrict or otherwise change these Terms.
SECTION 24 - CHANGES TO TERMS OF SERVICE
The current version of these Terms can be reviewed on this page at any time.
We may, in our sole discretion, replace, revise, or update a portion of these Terms by posting changes on the website. You are responsible for checking periodically. Material changes will be notified as applicable law requires and take effect when the applicable notice says they become effective. Continued access or use after posting means the changes are accepted.
